IMPORTANT LEGAL NOTICE

This Product Use & Legal Compliance Notice (“Notice”) describes important restrictions, responsibilities, and legal considerations applicable to the purchase, installation, possession, operation, and use of products offered by GhostVue, LLC (“GhostVue,” “we,” “us,” or “our”).

GhostVue products are designed to provide privacy functionality in specific lawful and controlled environments. Laws governing license plates, license-plate covers, vehicle equipment, plate visibility, obstruction, concealment, and related devices vary by jurisdiction and may change over time.

USERS ARE SOLELY RESPONSIBLE FOR ENSURING THAT THEIR PURCHASE, POSSESSION, INSTALLATION, DISPLAY, OPERATION, AND USE OF GHOSTVUE PRODUCTS COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS, RULES, REGULATIONS, AND ORDINANCES.

By purchasing, possessing, installing, accessing, or using a GhostVue product, you acknowledge and agree to the terms of this Notice.

1. OPAQUE MODE (“GHOST MODE”)

Certain GhostVue products include an Opaque Mode (also referred to as “Ghost Mode”) that allows the product to transition from a transparent or substantially transparent state to an opaque or substantially opaque state.

Opaque Mode is intended only for lawful use in controlled environments and circumstances where obscuring or limiting visibility of a license plate or other displayed information is legally permitted.

Examples of potentially appropriate uses may include:

  • Private property;
  • Vehicle shows, exhibitions, and displays;
  • Photography and videography;
  • Off-road environments;
  • Closed-course events;
  • Storage or display of a vehicle; and
  • Other lawful private-use situations.

The inclusion of a particular use in this list does not constitute a representation or warranty that such use is lawful in every jurisdiction or under every circumstance. Users remain responsible for determining whether a particular use is lawful.

2. PROHIBITED AND UNAUTHORIZED USES

GhostVue products are not designed, intended, authorized, or marketed for unlawful use.

GhostVue products must not be used in violation of any applicable law or regulation, including FOR THE PURPOSE OF UNLAWFULLY:

  • EVADING, OBSTRUCTING, OR INTERFERING WITH LAW ENFORCEMENT;
  • AVOIDING TOLLS, FEES, OR OTHER LAWFUL CHARGES;
  • DEFEATING OR INTERFERING WITH AUTOMATED LICENSE-PLATE READER SYSTEMS;
  • DEFEATING OR INTERFERING WITH TRAFFIC, RED-LIGHT, SPEED, OR OTHER ENFORCEMENT CAMERAS;
  • AVOIDING PARKING ENFORCEMENT;
  • CONCEALING VEHICLE IDENTIFICATION WHEN IDENTIFICATION IS LEGALLY REQUIRED;
  • OBSTRUCTING OR ALTERING THE LAWFUL DISPLAY OR READABILITY OF A LICENSE PLATE; OR
  • FACILITATING ANY OTHER UNLAWFUL ACTIVITY.

GHOSTVUE DOES NOT AUTHORIZE, ENCOURAGE, ENDORSE, OR CONDONE THE USE OF ITS PRODUCTS TO VIOLATE ANY FEDERAL, STATE, OR LOCAL LAW.

3. PUBLIC ROAD USE

OPAQUE MODE IS INTENDED FOR PRIVATE-PROPERTY AND OTHER LAWFUL CONTROLLED-ENVIRONMENT USE ONLY AND IS NOT INTENDED OR AUTHORIZED FOR USE ON PUBLIC ROADS WHERE SUCH USE IS PROHIBITED OR RESTRICTED BY LAW.

Before operating a vehicle on a public road, highway, street, or other public vehicular area, users should ensure that the GhostVue product is in Clear Mode or is otherwise configured and used in compliance with all applicable vehicle-registration, license-plate-display, visibility, obstruction, and vehicle-equipment requirements. THE ABILITY OF A GHOSTVUE PRODUCT TO ENTER OPAQUE MODE DOES NOT MEAN THAT ACTIVATION OR USE OF OPAQUE MODE IS LAWFUL ON A PUBLIC ROAD OR IN ANY PARTICULAR JURISDICTION. USERS ARE SOLELY RESPONSIBLE FOR DETERMINING WHEN AND WHERE THE PRODUCT AND EACH OF ITS OPERATING MODES MAY LAWFULLY BE USED.

4. COMPLIANCE WITH APPLICABLE LAWS

Laws governing vehicle equipment, license plates, license-plate covers, plate visibility, plate obstruction, vehicle identification, and related devices vary among states, municipalities, territories, provinces, and countries. Certain jurisdictions may prohibit or restrict the purchase, sale, possession, installation, display, or use of products that obscure, alter, cover, conceal, or otherwise affect the visibility or readability of a vehicle license plate. GhostVue does not represent or warrant that the purchase, possession, installation, display, operation, or use of a GhostVue product is lawful in any particular jurisdiction or under any particular circumstances.

Before purchasing, installing, possessing, or using a GhostVue product, customers should independently determine and comply with all laws applicable to their location, vehicle, and intended use. The absence of a jurisdiction from GhostVue’s restricted-jurisdiction list does not constitute a representation, warranty, or legal determination that the product or any particular use of the product is lawful in that jurisdiction.

5. USER RESPONSIBILITY

Users are responsible for the lawful and proper possession, installation, configuration, operation, maintenance, and use of GhostVue products.

Without limiting the foregoing, each user is responsible for:

  • Properly installing and maintaining the product;
  • Reading and following all manufacturer instructions, warnings, and notices;
  • Determining which laws apply to the product and its intended use;
  • Complying with all applicable federal, state, and local laws;
  • Ensuring that the product does not unlawfully obstruct or interfere with required vehicle identification;
  • Operating the product and vehicle in a safe and responsible manner; and
  • Discontinuing any use that is unlawful, unsafe, or inconsistent with GhostVue instructions or warnings.

To the fullest extent permitted by applicable law, GhostVue is not responsible for citations, tickets, fines, penalties, towing charges, vehicle impoundment, license or registration consequences, governmental actions, legal proceedings, or other losses or consequences arising from unlawful, unauthorized, or improper possession, installation, operation, or use of a GhostVue product.

6. INSTALLATION AND OPERATION

GhostVue products should be installed, configured, maintained, and operated in accordance with all instructions, specifications, warnings, and other documentation supplied by GhostVue.

Improper installation, modification, maintenance, or operation may:

  • Damage the GhostVue product;
  • Damage the vehicle or other property;
  • Reduce or impair product functionality;
  • Cause unintended operation;
  • Interfere with required vehicle equipment; or
  • Create safety or legal risks.

Users are responsible for confirming that installation of the product does not interfere with the lawful operation, visibility, identification, lighting, sensors, cameras, or other required equipment of the vehicle.

GhostVue is not responsible for damage or other consequences resulting from installation, modification, maintenance, or use contrary to supplied instructions or applicable law, to the fullest extent permitted by applicable law.

7. SALES AND SHIPPING RESTRICTIONS

GhostVue reserves the right, to the extent permitted by applicable law, to:

  • Refuse or cancel an order;
  • Limit the quantity of products purchased;
  • Restrict sales or shipments to particular jurisdictions;
  • Require additional customer, billing, or shipping verification;
  • Decline transactions that present legal or compliance concerns; and
  • Modify or discontinue product availability based on applicable legal requirements or GhostVue’s compliance policies.

GhostVue currently does not sell or ship its products to customers located in the following jurisdictions:

CALIFORNIA, DELAWARE, FLORIDA, HAWAII, ILLINOIS, MARYLAND, NEW YORK, PENNSYLVANIA, TENNESSEE, TEXAS, WASHINGTON, WISCONSIN, AND THE U.S. VIRGIN ISLANDS.

GhostVue may add or remove jurisdictions from this list as laws, regulations, enforcement practices, or GhostVue policies change. GhostVue reserves the right to reject, cancel, or refund any order that GhostVue determines may violate applicable law, this Notice, or GhostVue’s sales or shipping restrictions.

8. NO REPRESENTATION OF LEGALITY

THE AVAILABILITY OF A GHOSTVUE PRODUCT FOR SALE OR SHIPMENT TO A PARTICULAR LOCATION DOES NOT CONSTITUTE A REPRESENTATION, WARRANTY, OPINION, OR DETERMINATION BY GHOSTVUE THAT THE PRODUCT MAY LAWFULLY BE PURCHASED, POSSESSED, INSTALLED, DISPLAYED, OPERATED, OR USED IN THAT LOCATION OR FOR ANY PARTICULAR PURPOSE.

Similarly, GhostVue’s decision not to restrict sales to a particular jurisdiction does not constitute legal guidance concerning the laws of that jurisdiction. Customers and users remain independently responsible for determining the legality of their purchase, possession, installation, and intended use.

9. PRODUCT AND COMPLIANCE INFORMATION

GhostVue may periodically modify or update its products, hardware, software, firmware, mobile applications, product functionality, operating instructions, warnings, safety information, or compliance guidance. GhostVue may also modify this Notice or other product-related policies as laws, regulations, products, or business practices change. Users should review the GhostVue website and applicable product documentation periodically for current instructions, warnings, restrictions, and compliance information. Unless otherwise required by applicable law, GhostVue does not undertake an obligation to individually notify customers of every change in law, regulation, enforcement practice, product guidance, or compliance information that may affect a customer's use of a product.

10. NO LEGAL ADVICE

Information provided by GhostVue through its website, product packaging, instructions, user guides, mobile applications, customer communications, compliance notices, or other materials is provided for general informational and product-guidance purposes only.

NOTHING PROVIDED BY GHOSTVUE CONSTITUTES LEGAL ADVICE OR A LEGAL OPINION REGARDING THE LEGALITY OF A PRODUCT OR ITS USE IN ANY PARTICULAR JURISDICTION OR CIRCUMSTANCE.

Laws and regulations may change and may be interpreted or enforced differently among jurisdictions. Users with questions regarding applicable law should consult qualified legal counsel regarding their specific location, circumstances, and intended use.

11. ASSUMPTION OF RISK

By purchasing, installing, possessing, operating, or using a GhostVue product, the user acknowledges that laws governing license plates, vehicle equipment, and plate-obscuring or plate-covering devices vary by jurisdiction and that certain uses of the product may be restricted or prohibited. To the fullest extent permitted by applicable law, the user voluntarily assumes the risks associated with the possession, installation, operation, and use of the product, including risks arising from failure to comply with applicable law, product instructions, warnings, or this Notice.

Nothing in this section limits any rights or remedies that cannot lawfully be waived or restricted.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GHOSTVUE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PURCHASE, POSSESSION, INSTALLATION, OPERATION, OR USE OF A GHOSTVUE PRODUCT, INCLUDING DAMAGES OR LOSSES ARISING FROM UNLAWFUL, UNAUTHORIZED, OR IMPROPER USE.

GHOSTVUE WILL NOT BE RESPONSIBLE FOR CITATIONS, FINES, PENALTIES, TOLLS, FEES, TOWING OR IMPOUNDMENT COSTS, VEHICLE-REGISTRATION CONSEQUENCES, LAW-ENFORCEMENT ACTIONS, OR OTHER GOVERNMENTAL OR LEGAL CONSEQUENCES RESULTING FROM A USER’S POSSESSION, INSTALLATION, OPERATION, OR USE OF A GHOSTVUE PRODUCT IN VIOLATION OF APPLICABLE LAW.

Nothing in this Notice excludes, limits, or modifies any warranty, right, remedy, or liability that cannot lawfully be excluded, limited, or modified.

13. ACKNOWLEDGMENT

By purchasing, possessing, installing, accessing, operating, or using a GhostVue product, you acknowledge and agree that:

  • You have read and understand this Product Use & Legal Compliance Notice;
  • You understand that laws applicable to GhostVue products vary by jurisdiction;
  • You understand the restrictions applicable to Opaque Mode;
  • You are responsible for determining whether your possession, installation, and intended use of the product are lawful;
  • You will comply with all applicable federal, state, and local laws and regulations;
  • You will use the product in accordance with GhostVue’s instructions and warnings; and
  • You accept responsibility for the consequences of unlawful, unauthorized, or improper use of the product.

14. CHANGES TO THIS NOTICE

GhostVue reserves the right to modify, revise, or update this Notice from time to time to reflect changes in applicable law, product functionality, business practices, or compliance requirements. Any revised Notice will become effective when posted on the GhostVue website or on such later effective date as may be identified in the revised Notice. Continued possession, installation, operation, or use of a GhostVue product after an updated Notice becomes effective constitutes acknowledgment of the updated Notice to the extent permitted by applicable law.

15. SEVERABILITY

If any provision of this Notice is determined to be invalid, illegal, or unenforceable under applicable law, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

16. GOVERNING LAW

To the fullest extent permitted by applicable law, this Notice and any dispute arising out of or relating to it will be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict-of-laws principles. Subject to any applicable law providing otherwise, any action or proceeding arising out of or relating to this Notice will be brought exclusively in the applicable state or federal courts located in Summit County, Ohio.
